Dear Sir:-I have been informed that a document has been sent to Hon. Jos. S. Wilson Commissioner General, Land Office D.C. by one Martin Wardell (a copy of which I herewith enclose) asking the Commr. to set aside the entry of the South West Quarter of Section twenty-two, Township one South Range one, East, Salt Lake Meridian which entry was made by myself (James W. Cummings) on the 21st day of July 1869, not in the interest of Brigham Young as set forth in the statement of said Martin Wardell, but for myself, having occupied the same with my family since March 1st 1864.

I have upon said quarter Section improvements to the value of Seventy-five thousand dollars: viz -- A wolen factory, a tannery, a distillery, ten dwelling houses, the one I occupy contains nine larg rooms, the other dwellings are occupied by my employes. There are also other improvements necessary for carrying on my business of Manufacturing Cloth and leather &c. also a considerable portion of the land under cultivation.

The said Martin Wardell, about two years since erected a small house on said land against my protest for I objected at the time and told him, I required the quarter section and should enter it as soon as it came into market.

My improvements are located in the center of the quarter and I require it all for the carrying on of my business.

I therefore desire you to see the Commissioner at your earliest convenience and lay the facts before him that the entry may not be set aside, which would subject me to much trouble and expense.
