Your Affidavit were duly received. Many thanks for your promptness.
 
It seems however, by reference to Sec. 404. Chap. 3 of the Code of Utah, that a certificate by the Clerk of the Court, under the Seal of Court is necessary to prove the genuineness of the Judge's signature as well as the existence of the Court, and it is feared that your affidavits not have the desired effect.
 
Judge Sutherland (who has the case in hand) advises me to write for another affidavit, properly certified to, and he will present the one he has on Wednesday, and very little time will be granted, if any.
 
The Affidavit, referring to Marshal Patrick, as well as the service on De Wolf is proferred, no fears being entertained on Walker's account. Patrick is now in Washington and Jos. Nounnan is clerk of the Court at present.
 
Please give this matter your prompt attention. I would have made you a copy of the original and sent it to you to save you the trouble of writing, but it is preferable to have your own writing and other facts may have ocurred to your mind since you wrote last.

P. S. The last news from the Prest. is that he was at Kanarra, snow bound, the roads being to heavy for travel, his health was excellent.
