Mr. James W. Cumming,

Dear Bro:

Yours of the 27th ult. to the Prest. is just received. When read to him he remarked, "what does James want time for, the money is ready for the machinery, let him pay down and claim 10 per cent. discount for cash." (for whatever the discount may be.) The Prest. is quite unwell, he suffers from the effect of a severe cold. Marshall Patrick served a writ on the Prest. for "lewdly and lasciviously associating and cohabitating with Harriet Cook and many others." It was deemed best not to resist, and the President will appear in court as soon as he is able to be around, probably on Monday. Prest. Wells has just been before the court to-day on a similar charge. The policy is, to hire the best legal talent and fight the scalawags on their own ground. This policy has disconcerted their plans, for they anticipated he would either flee or resist and in either case they would make a disturbance. Messrs. Fitch & Mann, Hempstead and Kirkpatrick, Snow and Hoag are employed in the President's defense.

Mr. Clark of the Abel Loom concern called to see the Prest. and it appears asked $50.000 for the Territorial right which the Prest. of course refused to give, so that we may consider this matter closed for the present, because of the exorbitant demand.
