Hon. John F. Kinney
Nebraska City. Neb.

Dear Sir:

I have to congratulate you on the recent decision of the U.S. Supreme Court in the Englebrecht case. Although that decision has not reached us in full, we have received sufficient to inform us that it is a complete indorsement of the principles you so efficiently enunciated during your judicial career in Utah, and which called from me the following remark in a letter recently written to Attorney General Williams, suggesting your appointment as Chief Justice of Utah: "should the administration see proper to appoint him, I am safe to affirm -- judging from the past -- that they will have no occasion to blush at his judicial decisions, which would undoubtedly reflect credit upon the Government, and be highly satisfactory to the people."

There is some pleasure in proving the integrity of the Supreme Court at this particular crisis.

Give my best respects to your family and believe me as ever your friend and well wisher.

Geo. A. Smith
